WILCO AG (hereinafter also "we", "us") processes personal data concerning you or other persons (so-called "third parties"). We use the term "data" here synonymously with "personal data" (term according to DPA and GDPR).

In this Privacy Policy, we describe what we do with your data when you visit our website, purchase our services or products, are otherwise in contact with us under a contract, communicate with us or otherwise deal with us. In all respects, we take your data protection very seriously and treat your data confidentially and in accordance with the applicable legal regulations (e.g. the Swiss Data Protection Act (DPA) or the European General Data Protection Regulation (GDPR).

3. Collection and processing of your Personal Data

We collect and process various data about you. These are in particular:

  • which we receive from you, future customers, interested parties, service providers, suppliers; business partners or other persons involved in the business relationship;

  • that we receive about you in correspondence and meetings with third parties;

  • which we are legally or contractually obligated to collect;

  • that we collect when you use our website or other platforms;

  • which we obtain from publicly accessible sources (media, Internet) or public registers (debt collection registers, land registers, commercial registers, etc.);

  • which we receive from authorities and other third parties (address dealers, credit agencies).

 

Depending on the type of business relationship, we process the following categories of personal data:

  • Contact and identification data such as surname, first name, address, e-mail address, telephone number;

  • Personal details such as age, gender, nationality, place of birth, residence status, marital status, language, family data;

  • Financial data such as payment information, payment history, creditworthiness data, purchasing power;

  • Contract data such as contract type, contract content, type of products and services, consumption groups, consumption types, forecast data, applicable terms and conditions, contract start date, contract term, billing data;

  • Edge data from telecommunications traffic such as telephone number, date, time and duration of the connection, connection type, location data, IP address, device identification numbers;

  • Interaction and usage data: Correspondence, chat content, voice recordings, customer service information, transaction data, customer preferences, customer segment and target group information, end device type, device settings, operating system, software, information from assertion of rights, feedback;

  • Website information: Website, IP address, cookie information, browser settings, frequency of visits to the website, duration of visits to the website, search terms, clicks on content, originating website.

4. Provision of the Website

4.1 The description and scope of data processing

When you visit our website and each time you download documents, our system collects automated data and information from the computer system belonging to the computer making the request. The data is stored in the Server Llogfiles of our system.

The following data is logged:

  • Visited website

  • Time of access

  • Amount of data sent in bytes

  • Source/reference directing you to the page

  • Browser used

  • Operating system used

  • Used IP address

We have a legitimate interest in processing the data, in particular for planning or product development and for business statistics and business decisions (e.g. determining key figures on the use of services, developing new ideas or evaluating or improving and reviewing existing products, services, processes and technologies). If data must be retained for reasons of proof, it is excluded from deletion until the incident has been completely processed.

4.2 Use of cookies

We use cookies on our website on the basis of our legitimate interests. Cookies are small text files that are placed and stored on your end device (laptop, tablet, smartphone, etc.) with the help of the browser. They serve to make our website more user-friendly and effective overall and to make your visit to our website as pleasant as possible. Cookies do not cause any damage to your end device. They cannot execute programs or contain viruses.

Among other things, we use so-called session cookies. These are automatically deleted when you log out or close the browser. Otherwise, the data processed using cookies will be processed on the basis of our legitimate interests (e.g. in the analysis and optimization of our services and offers) or, if the use of cookies is necessary to fulfill our contractual obligations.

4.3 Use of SalesViewer® technology

This website uses SalesViewer® technology from SalesViewer® GmbH to collect and save data for marketing, market research and optimization purposes. You can find SalesViewer's privacy policy at: https://www.salesviewer.com/en/privacy-policy/?.

For this purpose, a javascript-based code is used to collect company-related data and use it accordingly. The data collected with this technology is encrypted in a non-reversible one-way function (so-called hashing). The data is immediately pseudonymized and is not used to identify website visitors personally.

The data stored by SalesViewer® will be deleted as soon as it is no longer required for its intended purpose and there are no legal obligations to retain them.

The data recording and storage can be repealed at any time with immediate effect for the future, by clicking on https://www.salesviewer.com/opt-out in order to prevent SalesViewer® from recording your data. In this case, an opt-out cookie for this website is saved on your device. If you delete the cookies in the browser, you will need to click on this link again.

5. Data Protection

As the website operator, we use SSL encryption to protect your transmitted data in the best possible way. You can recognize such encrypted connections by the prefix "https://" in the page link in the address bar of your browser. Unencrypted pages are marked with "http://".

Any data that you submit to this website - such as inquiries or logins - cannot be read by third parties thanks to SSL encryption.

6. Contact

The data you enter in the contact form will be stored for the following purposes:

  • individual communication with you,

  • to process your request efficiently,

  • to provide a better service for future requests,

  • for the preparation and implementation of pre-contractual measures, and

  • for the further development of our products and services.

For this purpose, you must provide a valid e-mail address, your first and last name, your company and your request (*). This is used to assign the request and subsequently respond to it. By providing the contact form, we would like to make it easy for you to contact us (e.g. regarding inquiries, requests for quotations, contractual relationships, etc.). 

We have a legitimate interest in storing your data in our "Customer Relationship Manager" (CRM) in order to guarantee you the above-mentioned purposes. The storage takes place regardless of whether a contractual relationship is established. If you wish your data to be deleted, you can inform us of this at datenschutz[at]wilco.com.

We would like to point out that data transmission over the Internet (e.g. when communicating by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.

7. Job Application

When you apply for a job with us, we process the data that we receive from you as part of the application process. In addition to your personal details, education, work experience and skills, this includes the usual correspondence data such as postal address, e-mail address and telephone number. In addition, all documents submitted by you in connection with your application, such as your letter of motivation, CV and references, will be processed. Applicants can also voluntarily provide us with additional information. This data will only be stored, evaluated, processed or forwarded internally as part of your application. It may also be processed for statistical purposes (e.g. reporting). In this case, it is not possible to draw conclusions about individual persons.

Processing may also take place by other electronic means. This is particularly the case if you send us the relevant application documents electronically, for example by e-mail or using an online form on our website.

If application documents are submitted, the data will be processed on the basis of the applicable data protection regulations. The provision of the data is necessary for the assessment of suitability for the advertised position and thus for the possible conclusion of a contract. Failure to provide the data would mean that the application could not be considered for the advertised position. The data will be forwarded to the following recipients:

  • to the responsible employees in the human resources department,

  • to the supervisor of the position for which you are applying.

The data will be stored until the application process is completed. If no contractual relationship is established between us, we will store your data for up to 3 months after the rejection and then delete it.

You can object to this data processing at any time and withdraw your application. Please send your objection to the person named as contact person in the job advertisement or to the e-mail address datenschutz[at]wilco.com.

8. Newsletter and Marketing Emails

8.1 Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter.

We use this data exclusively for sending the requested information.

You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter.

The registration for our newsletter is done in a so-called double opt-in procedure. This means that after registering, you will receive an e-mail asking you to confirm your registration. This confirmation is necessary so that no one can register with foreign e-mail addresses.

Subscriptions to the newsletter are logged in order to be able to prove the registration process in accordance with legal requirements. This includes storing the time of registration and confirmation as well as the IP address.

8.2 Rapidmail

We use Rapidmail to send newsletters. The provider is Rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i.Br., Germany. You can find Rapidmail's privacy policy at: https://www.rapidmail.de/datenschutz .

If you do not wish your data to be processed by Rapidmail in accordance with section 8.1, you must unsubscribe from the newsletter. We provide a link for this purpose in every newsletter message. You can also unsubscribe from the newsletter directly on the website.

8.3 Data analysis by Rapidmail

For analytical purposes, e-mails sent via Rapidmail contain a so-called "tracking pixel", which connects to the Rapidmail servers once the e-mail is opened. As a result, it is possible to determine whether a newsletter e-mail was actually opened.

With the assistance of Rapidmail we are also able to determine whether and which links in the newsletter message the recipient clicked. All links integrated into the e-mail are so-called tracking links that enable us to count your clicks.

9. Google Analytics

Based on our legitimate interests, we use Google Analytics, a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, or, if you have your habitual residence in the European Economic Area (EEA) or Switzerland, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

Google uses cookies. The information generated by the cookie about your use of our website (including your IP address) is usually transmitted to a Google server in the USA or Ireland and stored there.

We only use Google Analytics with activated IP anonymization. This means that your IP address is truncated by Google within Switzerland or the EU/EEA before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

Google uses this information for the purpose of evaluating your use of our website, compiling reports on website activity and providing us with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent the collection of the data generated by the cookie and related to your website use (including your IP address) and its transmission to Google, as well as the processing of this data by Google, by downloading and installing the browser add-on available at the following link http://tools.google.com/dlpage/gaoptout?hl=de. An opt-out cookie will be set that prevents the future collection of your data when visiting our website. 10. LinkedIn

This website integrates plugins from the LinkedIn network of LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA ("LinkedIn"). A connection to the LinkedIn servers is established whenever you access any of our pages that contain LinkedIn functionality. LinkedIn is notified that you have visited our website with your IP address. If you click on the LinkedIn "Recommend" button and are logged into your LinkedIn account, LinkedIn is able to associate your visit to our website with you and your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by LinkedIn. 11. Facebook

Our website uses plugins from the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA. You can recognize them by the "Like button" or the Facebook logo.

When you start a YouTube video on our website, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. This information (including your IP address) may be transmitted to a Google server in the USA and stored there. If you are logged into your YouTube account at the same time, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account before visiting our website.

We use YouTube in the so-called extended data protection mode. According to YouTube, this mode means that YouTube does not store any data about you as a visitor to our website before you watch or play the video. 13. Data Transfer and Data Transmission Abroad

We treat your data confidentially and only pass it on if you have expressly consented to this, if we are legally obliged or entitled to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship. In addition, we will pass on your data to third parties if this is necessary or expedient in the context of using the website or for the provision of any services requested by you (including outside the website).

We disclose your data to the following categories of recipients:

  • Business partner;

  • Service operator;

  • Subcontractor;

  • Collection partner;

The recipients are predominantly in Switzerland but may also be based outside Switzerland. If we use partners or service providers to provide our services, your data may be transferred to other countries in Europe and the USA where the service providers we use are located (e.g. Microsoft, Google).

It goes without saying that we comply with the legal regulations on the transfer of data to third parties. If we use processors to provide our services, we take suitable legal precautions and appropriate technical and organizational measures to ensure the protection of your data in accordance with the relevant legal regulations.

Insofar as processing takes place in countries whose legislation does not provide an adequate level of data protection, the protection of your data is ensured by means of the legally prescribed precautions, such as in particular the conclusion of contractual agreements (standard contractual clauses of the European Commission) and appropriate technical and organizational measures.

14. Duration of Storage of your Data

We only process and store your data for as long as is legally required or necessary to provide the service you have requested or for the purposes pursued with the processing, i.e. for the duration of the entire business relationship (from the initiation, processing to the termination of a contract), in accordance with the statutory retention and documentation obligations and beyond that in the case of legitimate business interests (e.g. for evidence and documentation purposes). If there are no legal or contractual obligations to the contrary, we delete or anonymize your data after the storage or processing period has expired as part of our usual processes in order to act in accordance with the law (in particular the DPA and GDPR).

15. Data Security

We take appropriate technical and organizational measures to protect your data from unauthorized access and misuse. These security measures include IT and network security solutions, encryption of data carriers and transmissions, access controls and restrictions, the issuing of directives, confidentiality agreements, checks and employee training. We regularly review our security measures and adapt them to the state of the art. We also oblige our contract processors to take appropriate security measures. However, security risks cannot generally be completely ruled out; residual risks are unavoidable.

You have the following rights within the framework of the data protection law applicable to you (e.g. DPA or GDPR), and insofar as provided therein:

  • the right to request information from us as to whether and which of your data we process;

  • the right to have us correct data if it is incorrect;

  • the right to request the deletion of data;

  • the right to obtain from us the release of certain data in a commonly used electronic format;

  • the right to withdraw consent where our processing is based on your consent;

  • the right to object to the processing of your data, in particular for the purposes of direct marketing and other legitimate interests in the processing;

  • the right to receive, upon request, further information necessary for the exercise of these rights;

  • the right to express your point of view on automated individual decisions and to request that the decision be reviewed by a natural person.
